Terms of Service

1. Acceptance of terms

By creating an account or using any part of the Kwamle Media platform (kwamlemedia.com and its apps and APIs), you agree to be legally bound by these terms. If you do not agree, please discontinue use of the service immediately.

2. Account & security

• Provide accurate, complete information.
• Update your information when it changes.
• Use a strong password and enable 2-factor authentication.
• Not share your account with anyone outside your team.

3. Subscription & billing

• Subscriptions renew automatically (monthly or yearly) until you cancel them from your dashboard.
• Prices are displayed in USD and EGP based on your selection.
• We reserve the right to change prices with 30 days' notice to you.
• Paid amounts are non-refundable except in the specific cases listed below.
• Cancelling your subscription stops the next renewal but does not refund any amount already paid for the current period.
• If we suspend your account due to a violation of these terms, no refund is due.

4. Permitted use

You may use the platform for legitimate marketing automation purposes, including:

• Build chatbots, marketing automations, and online stores for your own business.
• Manage your customers' Facebook and Instagram Pages with their consent.
• Send marketing messages only to subscribers who have opted in.
• Provide your own services to clients (e.g., marketing agencies) provided they have signed appropriate agreements.

5. Prohibited use

It is strictly prohibited to use the platform for:

• Send unsolicited spam.
• Distribute illegal, fraudulent, or harmful content.
• Violate Meta's policies for Facebook and Instagram.
• Attempt to reverse-engineer or copy the platform.
• Resell access without explicit written permission from us.
• Use bots in a way that misleads users about whether they're speaking with a human or AI.
• Reselling or sublicensing the service without an explicit written agreement.

Any violation of this section may result in immediate suspension or termination of your account without refund.

6. Content & intellectual property

• All content you upload (texts, images, customer data) remains your property.
• You grant us a limited license to host, process, and back up your content for the sole purpose of providing the service.
• The platform itself, including its code, design, and brand, remains the intellectual property of Kwamle Media.

7. AI usage

• Disclose to your end-users that they may be talking to AI.
• Not use AI to spread misinformation.
• Comply with the terms of the AI provider whose key you're using.
• Content generated by AI is your responsibility — review carefully before publishing.

8. Service availability

We aim for 99.99% uptime, but we do not guarantee that the service will be free of interruptions. We will give advance notice of scheduled maintenance.

9. Limitation of liability

To the maximum extent permitted by law:

• The service is provided "as is" without express or implied warranties.
• We are not liable for indirect, consequential, or special damages.
• Our total liability for any claim is limited to the total amount you have paid us in the 12 months preceding the claim.

10. Termination

• You may close your account at any time from the dashboard.
• We may suspend or terminate your account if you breach these terms, with 30 days' notice for non-critical violations.
• After termination, your data is retained for 30 days to allow recovery, then permanently deleted.

11. Changes to terms

We may amend these terms occasionally. Material changes will be announced 30 days in advance. Continued use after the changes take effect constitutes acceptance.

12. Governing law

These terms are governed by the laws of the Arab Republic of Egypt. Any dispute is exclusively subject to the jurisdiction of the courts of Cairo. Enterprise customers may negotiate a different governing law within their main agreement.
